Established in 1967\, the organization’s membership of nearly 5\,000 spans the United States and many other countries. With 140 chapters\, NSAI is dedicated to protecting songwriter’s rights and serves aspiring and professional songwriters in all genres of music. \nUnder Herbison’s leadership NSAI gained prominence in the national legislative arena. DESCRIPTION:October 28\, 2016 Meeting\n\nThe Copyright Society of the South invites you to a luncheon meeting on Friday\, October 28\, 2016 from 11:30am to 1pm at ASCAP’s Connie Bradley Board Room. \nTOPIC:  All the way from Middle Class to Class Action – Legal issues regarding the music of The Turtles. \nSPEAKER:   Mark Volman\nMark Volman is a founding member\, lead singer and manager of “The Turtles\,” who continue to tour over 50 concerts a year.  Their song “Happy Together” has just received a BMI award for 9 million radio air performances and was placed in to the Grammy Hall of Fame. In the 70’s\, Mark joined up with Frank Zappa & the Mother’s of Invention where he made 10 albums and wrote and starred in the United Artist’s feature film\, “200 Motels.”  Mark has also sung with such notable artists as John Lennon\, Bruce Springsteen\, T.Rex\, Todd Rundgren\, Stephen Stills\, The Ramones\, Lou Reed\, U2 and many more.  He has written songs for children’s television \, such as the Care Bears and Strawberry Shortcake and received a Grammy nomination for these works.  Mark has survived in the music business for over 38 years as an on-air radio personality\, radio syndication\, record producer and writer for national music magazines and network television.  “The Turtles featuring Flo & Eddie” continue to be one of America’s most successful touring groups\, performing 40 to 60 concerts around the world every year. \nHe is an Assistant Professor and Chair of the Entertainment Industry Studies program in the Mike Curb School for Entertainment and Music Business and before that was a member of the Loyola Marymount University faculty from 1997 – 2003.  Areas of specialization: music business\, Entertainment Industry Studies and popular music history. \nMark is a member and conference attendee of the College Music Society\, the National Academy of Recording Arts and Sciences and Music and Entertainment Industry Educators Association\, as well as consultant for professional musicians.  He is a member of AFTRA/SAG and Local 47 of the musician’s union.  He is on the Board of Director’s of Leadership Music in Nashville. DESCRIPTION:TOPIC: A look at the division of income among  writers\, publishers\, labels and artists at Spotify\, Pandora and SiriusXM\, plus current legislative updates. \nSPEAKER:  David Israelite\nDavid Mark Israelite is the President and Chief Executive Officer of the National Music Publishers’ Association.  Founded in 1917\, The National Music Publishers’ Association (NMPA) is the premiere trade association representing American music publishers and their songwriter partners. The NMPA’s mandate is to protect and advance the interests of music publishers and their songwriter partners in matters relating to the domestic and global protection of music copyrights. Music publishers control the copyrights for the underlying compositions of songs on behalf of the songwriters they represent. The Harry Fox Agency\, Inc.\, the leading U.S. mechanical rights organization\, is a wholly owned subsidiary of the NMPA. \nFrom 2001 through early 2005 Israelite served as Deputy Chief of Staff and Counselor to the Attorney General of the United States.  In this capacity he helped manage the United States Department of Justice’s 112\,000 employees and $22 billion annual budget.  In addition to his general management responsibilities\, Israelite served as the Attorney General’s personal advisor on all legal\, strategic and public affairs issues.  In March of 2004\, the Attorney General appointed Israelite Chairman of the Department’s Task Force on Intellectual Property.  As Chairman Israelite lead a team of high-ranking officials in examining all aspects of how the Department of Justice handled intellectual property issues and implemented proposals developed by the Task Force.\nPrior to joining the Department of Justice\, Israelite served as the Director of Political and Governmental Affairs for the Republican National Committee.  In that role he was the senior advisor to the Chairman of the National Republican Party\, and was responsible for the Republican Party’s Campaign Operations\, Government Affairs\, Research\, and Presidential Liaison Divisions. \nFrom 1997 through 1998\, Israelite served as Missouri Senator Kit Bond’s Administrative Assistant\, making him the youngest AA in the United States Senate.  Israelite also served as Campaign Manager for Senator Bond’s successful 1998 re-election campaign. \nFrom 1994 through 1997\, Israelite practiced law in the Commercial Litigation Department at the firm of Bryan Cave\, LLP in Kansas City\, Missouri.  Israelite earned his Juris Doctor from the University of Missouri in 1994 and received a B.A. in a double major of Political Science and Communications from William Jewell College in 1990.  While in college\, Israelite was named Top Speaker by the National Cross Examination Debate Association\, recognizing him as the nation’s top collegiate debater.

DESCRIPTION:TOPIC\nAll is Fair (Use) In Love and Copyright \n  \nSPEAKER\nStephen Zralek: Bone\, McAllester\, Norton\nCopyright law gives exclusive rights to authors of original works\, but the Fair Use doctrine limits those rights.  Stephen Zralek looks at several close cases and lets audience members judge for themselves as to whether the infringement should be permitted under the Fair Use defense.  The presentation is interactive\, comparing side-by-side examples of original works with later works where the original author claims infringement.  Examples include a comparison of Margaret Mitchell’s Gone with the Wind\, and The Wind Done Gone by Nashville author Alice Randall; a comparison of the original Roy Orbison’s “Pretty Woman” song and 2 Live Crew’s version of it; and a comparison of more recent works created by contemporary photographer Patrick Cariou and appropriation artist Richard Prince.  We’ll explore recent decisions from within the Sixth Circuit and around the country\, examining the four factors that courts examine when determining fair use. \nStephen Zralek is an artist at heart and\, despite being a lawyer\, finds himself regularly manipulated by his two children.  He practices at Bone McAllester Norton where he is a Member of the Firm.  He is a litigator focused IP\, entertainment\, and business disputes.  He previously served as Chair of the Copyright Litigation Committee of the ABA’s IP Law Section\, and is a regular author and speaker on IP legal issues and social media.  Stephen is on the board of Conexion Americas\, and is the co-founder of WaterCooler\, a monthly networking event that highlights Nashville’s cultural richness.  He tweets at @StephenZralek\, and blogs at www.TheExpressive.com.
