DESCRIPTION:Danielle Aguirre\, Executive Vice President & General Counsel of the National Music Publishers’ Association (NMPA)\, will present information regarding the Phonorecords II Remand\, updates since the July 1 response to the CRB\, and the Remand’s potential impacts to the copyright landscape. \nAbout Danielle Aguirre \nDanielle oversees all of NMPA’s legal\, business and policy objectives.  Her role is to protect and enforce the copyrights and intellectual property interests of songwriters and music publishers.  Ms. Aguirre has aggressively fought digital piracy and infringement litigating against digital platforms\, and she works with the largest companies\, digital services and record labels to ensure that publishers and songwriters are being fairly compensated for the use of their songs. \n \nMs. Aguirre was integrally involved in the negotiation\, drafting and passage of the Music Modernization Act\, legislation that amended U.S. Copyright law and led to the creation of a new licensing company\, the Mechanical Licensing Collective (MLC).  After co-leading a team that developed the MLC\, she currently serves as the statutorily designated non-voting publisher representative on the MLC board.  In 2018\, Billboard honored her as the Women in Music Co-Executive of the Year for her work on the MMA and MLC. \n \nPrior to joining NMPA\, Ms. Aguirre was an attorney at Paul\, Weiss\, Rifkind\, Wharton and Garrison LLP. The good news is that under US copyright law\, comedians and other spoken word performers have the exact same copyrights and even better legal rights than musical songwriters. This means the licenses and accompanying royalties are not at all imaginary but required and protected under the existing laws. DESCRIPTION:GUEST SPEAKER:  Bart Herbison  \nBart Herbison is Executive Director of the Nashville Songwriters Association International (NSAI) with 100 domestic and international chapters.  NSAI is the world’s largest not-for-profit trade organization dedicated to the songwriting profession. Established in 1967\, the organization’s membership of more than 5\,000 spans the United States and may other countries.  NSAI is dedicated to protecting songwriter’s rights and serves aspiring and professional songwriters in all genres of music. \nUnder Herbison’s leadership NSAI gained prominence in the national legislative arena. Accomplishments include: \n\nAdoption of the historic “Music Modernization Act” in 2018\, the most important copyright reform bill for American songwriters in the modern era of music. DESCRIPTION:GUEST SPEAKER:  Regan Smith \nRegan Smith is the General Counsel and Associate Register of Copyrights for the United States Copyright Office. She was appointed to the position effective May 27\, 2018.In her position as General Counsel\, Smith provides legal guidance to the various divisions and programs of the Office\, including the national registration and recordation systems\, and she is frequently called upon by congressional offices\, the U.S. Department of Justice\, and other federal agencies for advice and assistance. She also has primary responsibility for the formation and promulgation of regulations and the adoption of legal positions governing policy matters and practices of the Copyright Office. Since joining the Office\, Smith has been involved in music copyright issues\, including advising congressional offices with respect to the Music Modernization Act\, and she now leads the Office’s efforts to implement this historic law through regulatory and other activities on behalf of the Register of Copyrights. \nBefore joining the Copyright Office\, Smith spent several years in private practice\, where she represented a variety of clients in matters concerning copyright\, technology\, media\, and related intellectual property issues. He is also an Adjunct Professor at George Mason University Law School\, where he teaches Regulated Industries\, and a Visiting Scholar at the American Enterprise Institute. Previously\, Dr. Eisenach has served in senior policy positions at the US Federal Trade Commission and the White House Office of Management and Budget\, and taught at Harvard University’s Kennedy School of Government and Virginia Polytechnic Institute and State University. Dr. Eisenach’s consulting practice focuses on economic analysis of competition\, regulatory\, intellectual property and consumer protection issues. Massarsky has been operating as a music industry economist since 1981.  After graduating Cornell University with his MBA\, he became the Senior Economist at ASCAP and then in 1992\, formed his own economic consulting firm which now includes four music economic consultants\, including his partner\, Ms. Nari Matsuura.  For the last consecutive 28 years\, he has served as the outside economist for both RIAA and SESAC and co-developed the strategies that lead to the formation of SoundExchange.  He has been the performance rights outside expert for both UMPG and Warner Chappell since 2003\, as well as currently serving in a similar capacity for SONY/ATV.  He also contributes to the economic and strategic positioning for both MUSICFIRST and SESAC in their respective dealings concerning terrestrial radio licensing. His firm presently provides music catalog valuations for most players comprising the music copyright financial marketplace and is recognized as a first-in-class valuation firm by both the significant commercial lenders and privately held funds in this space. DESCRIPTION:GUEST SPEAKER:  H. Beecher Hicks\, III \n \n  \nH. Beecher Hicks III’s professional experiences have included work in the private\, public and nonprofit sectors\, where he has focused on building enterprises as a consultant\, banker\, investor and operating executive. Henry is now the president and CEO of the National Museum of African American Music\, or NMAAM (www.nmaam.org). His relationship with the project began in 2010 when he began serving on NMAAM’s board before becoming CEO in 2013. From traditional African drum beats to modern hip-hop\, the 56\,000-square-foot experiential museum will highlight the many contributions African Americans have made to American music and culture. \nAs a former investment banker and current private equity investor\, Henry is first and foremost a deal-maker. His prior banking experience includes roles as an investment banker at Bank of America in Charlotte\, N.C.\, where he closed more than $1 billion in middle market transactions\, as an operating principal with Onyx Capital Ventures\, achieving more than 25 percent top-line growth for his portfolio companies. He currently serves as a partner with private equity group Red Clay Capital Holdings. Henry draws on his business experience to lead NMAAM’s fundraising efforts and provide the museum with a sturdy fiscal foundation. \nIn 1998\, Henry was appointed by President William J. Clinton to be a White House Fellow. In this capacity\, he was senior adviser to the CEO of the Corporation for National and Community Service and launched the AmeriCorps Promise Fellows program on behalf of the president and Gen. Colin Powell. Henry is a member of the boards of directors for Leadership Nashville\, University School of Nashville and Nashville’s Center for Nonprofit Management. He served previously on the board of directors for the Nashville Convention and Visitors Corporation and United Therapeutics Corporation (Nasdaq: UTHR)\, where he served on the audit and compensation committees. \nThe son of a preacher\, he grew up in the church\, where he developed a passion for music. He explored his talents as a member of the Morehouse College Glee Club\, where he earned a scholarship to sing and completed a Bachelor of Arts degree in marketing. After graduating from Morehouse\, Henry continued his education to earn a Master of Business Administration degree in finance from the University of North Carolina at Chapel Hill. His musical passion is a vital asset at NMAAM\, where he combines his financial acumen with the fervor of a musical scholar and fan. SUMMARY:November 8\, 2018 - Songwriter Series:  A Special Evening with Mac Davis
DESCRIPTION:GUEST PERFORMING ARTIST:  Mac Davis \nAt his commercial peak in the mid-’70s\, Mac Davis was one of America’s most popular entertainers\, a countrypolitan-styled singer and actor who found considerable success in both fields. After moving to Georgia\, Davis first broke into the music business in 1962\, when he was hired by the Chicago-based record label Vee-Jay as their Atlanta-based regional manager. After joining the Liberty label three years later\, in 1967 he moved to Los Angeles to head the company’s publishing arm\, Metric Music; in addition to running Metric’s day-to-day operations\, he also began composing his own songs\, with Glen Campbell\, Bobby Goldsboro\, Lou Rawls\, and Kenny Rogers & the First Edition among the artists recording his work. \nIn 1968\, Elvis Presley recorded Davis’ “A Little Less Conversation\,” and soon after the King was requesting more of his work. After notching a Top 40 hit with Davis’ “Memories\,” Presley reached the Top Five in 1969 with the songwriter’s “In the Ghetto\,” a single from the landmark From Elvis in Memphis LP. Davis also arranged the music for Presley’s first television special before signing his own recording contract in 1970. In that year\, he released his first chart single\, “Whoever Finds This\, I Love You\,” from his debut album\, Song Painter. \nIn 1972\, Davis scored a number one pop hit with “Baby\, Don’t Get Hooked on Me\,” which also reached the country Top 20. His crossover success continued throughout the decade\, with singles like 1974’s “Stop and Smell the Roses\,” 1975’s “Burnin’ Thing\,” and the following year’s “Forever Lovers” scoring with listeners in both camps. Between 1974 and 1976\, Davis hosted a musical variety show for NBC television\, followed by a string of specials; in 1979\, he also starred in the film North Dallas Forty with Nick Nolte. \nDavis’ success continued in the early ’80s; “It’s Hard to Be Humble\,” the title track of his 1980 album\, was the first of four consecutive Top Ten country hits that culminated with his biggest country single\, “Hooked on Music\,” the next year. In 1980\, he also starred in a TV movie\, Cheaper to Keep Her. However\, a co-starring role opposite Jackie Gleason and Karl Malden in 1983’s disastrous The Sting II effectively ended Davis’ career in Hollywood\, and by 1985\, he had recorded his last Top Ten hit\, “I Never Made Love (Till I Made Love With You).” In 1990\, Davis made a comeback as a songwriter\, co-authoring Dolly Parton’s hit “White Limozeen”; that same year\, he also took over the title role in the Broadway hit The Will Rogers Follies. DESCRIPTION:GUEST SPEAKER:  Richard S. Busch \nRichard S. Busch is a Partner in the Litigation Section and is Head of the Entertainment and Intellectual Property Sections of King & Ballow. His practice areas include Litigation (State and Federal)\, Entertainment Litigation\, Intellectual Property Litigation\, and Commercial Litigation. Prior to joining the firm\, Mr. Busch served as Law Clerk to the Honorable John V. Parker\, Chief Judge of the United States District Court for the Middle District of Louisiana. \nMr. Busch received his law degree from Loyola University Law School where he was a member of the Loyola University Law Review and the Moot Court Board\, serving as Spring National Team Coach. In addition\, Mr. Busch received the American Jurisprudence Award for Secured Transactions and the Fishman Award as the outstanding commercial law student. \nMr. Busch has successfully represented clients in numerous trial and appellate court cases. In the action styled F.B.T. Productions\, LLC v. Aftermath Records\, et al.\, Mr. Busch represented the Plaintiff\, who discovered\, produced\, and co-wrote some of recording artist Eminem’s biggest hits\, in the landmark case\, in which the United States Court of Appeals for the Ninth Circuit entered judgment in favor of F.B.T.\, finding that the agreements between record label Universal and digital download providers like iTunes\, are licenses\, and Eminem’s recording agreement entitled him and F.B.T. to 50 percent of Universal’s net receipts for sales by iTunes and others of Eminem songs.
