On February 5\, 2020\, he spoke about AI and creating music at the “Copyright in the Age of Artificial Intelligence” symposium sponsored by the U. S. Copyright Office and World Intellectual Property Organization at the Library of Congress.  As expert witness\, he is responsible for freeing the iconic civil rights anthem\, “We Shall Overcome\,” on January 26\, 2018. DESCRIPTION:SPEAKERS:  Dr. Jeffrey Eisenach and Barry Massarsky\nDr. Jeffrey Eisenach is a Managing Director and Co-Chair of NERA’s Communications\, Media\, and Internet Practice\, and serves on the firm’s Board of Directors. He is also an Adjunct Professor at George Mason University Law School\, where he teaches Regulated Industries\, and a Visiting Scholar at the American Enterprise Institute. Previously\, Dr. Eisenach has served in senior policy positions at the US Federal Trade Commission and the White House Office of Management and Budget\, and taught at Harvard University’s Kennedy School of Government and Virginia Polytechnic Institute and State University. Dr. Eisenach’s consulting practice focuses on economic analysis of competition\, regulatory\, intellectual property and consumer protection issues. He has submitted expert reports and testified in US federal court as well before the Antitrust Division of the U.S. Department of Justice\, the Federal Trade Commission\, the Copyright Royalty Board\, the Federal Communications Commission\, the International Trade Commission\, US Tax Court\, several state public utility commissions\, and courts and regulatory bodies in Australia\, Canada\, the United Kingdom\, India\, the Caribbean\, and South America. He has also advised clients in some of the world’s largest information technology sector mergers. He has written or edited 19 books and monographs\, including Broadband Competition in the Internet Ecosystem and Competition\, Innovation and the Microsoft Monopoly: Antitrust in the Digital Marketplace. His writings have also appeared in scholarly journals such as The Review of Network Economics\, as well as in popular outlets like Forbes\, The New York Times\, and The Wall Street Journal. Prior to joining NERA\, Dr. Eisenach was a managing director and principal at Navigant Economics\, and before that he served as Chairman of Empiris LLC\, Criterion Economics\, and CapAnalysis\, LLC. Among his other previous affiliations\, Dr. Eisenach has served as President and Senior Fellow at The Progress & Freedom Foundation; as a scholar the Heritage Foundation\, and the Hudson Institute; as a member of the 1980-81 Reagan-Bush Transition Team on the Federal Trade Commission\, the 2000-2001 Bush-Cheney Transition Team on the Federal Communications Commission\, the Virginia Governor’s Commission on E-Communities\, and the Virginia Attorney General’s Task Force on Identity Theft. In 2016-2017 he led the Trump-Pence Transition Team for the Federal Communications Commission. Dr. Eisenach received his PhD in economics from the University of Virginia and his BA in economics from Claremont McKenna College.                               \nBarry M. Massarsky has been operating as a music industry economist since 1981.  After graduating Cornell University with his MBA\, he became the Senior Economist at ASCAP and then in 1992\, formed his own economic consulting firm which now includes four music economic consultants\, including his partner\, Ms. Nari Matsuura.  For the last consecutive 28 years\, he has served as the outside economist for both RIAA and SESAC and co-developed the strategies that lead to the formation of SoundExchange.  He has been the performance rights outside expert for both UMPG and Warner Chappell since 2003\, as well as currently serving in a similar capacity for SONY/ATV.  He also contributes to the economic and strategic positioning for both MUSICFIRST and SESAC in their respective dealings concerning terrestrial radio licensing. His firm presently provides music catalog valuations for most players comprising the music copyright financial marketplace and is recognized as a first-in-class valuation firm by both the significant commercial lenders and privately held funds in this space. DESCRIPTION:GUEST SPEAKER:  Regan Smith \nRegan Smith is the General Counsel and Associate Register of Copyrights for the United States Copyright Office. She was appointed to the position effective May 27\, 2018.In her position as General Counsel\, Smith provides legal guidance to the various divisions and programs of the Office\, including the national registration and recordation systems\, and she is frequently called upon by congressional offices\, the U.S. Department of Justice\, and other federal agencies for advice and assistance. She also has primary responsibility for the formation and promulgation of regulations and the adoption of legal positions governing policy matters and practices of the Copyright Office. Since joining the Office\, Smith has been involved in music copyright issues\, including advising congressional offices with respect to the Music Modernization Act\, and she now leads the Office’s efforts to implement this historic law through regulatory and other activities on behalf of the Register of Copyrights. \nBefore joining the Copyright Office\, Smith spent several years in private practice\, where she represented a variety of clients in matters concerning copyright\, technology\, media\, and related intellectual property issues. Smith earned her JD from Harvard Law School\, and her BA in philosophy and political science from the University of Michigan. Accomplishments include: \n\nAdoption of the historic “Music Modernization Act” in 2018\, the most important copyright reform bill for American songwriters in the modern era of music. DESCRIPTION:Dr. E. Michael Harrington is a composer\, musician\, consultant\, professor\, and course author and professor at Berklee College Online. Harrington served as expert at the U.S. Copyright Office and World Intellectual Property Organization’s symposium Copyright in the Age of Artificial Intelligence at the Library of Congress in February 2020.  He created the Coursera/Berklee College of Music Copyright Law In The Music Business class/MOOC which has been taken by students from 169 countries from Afghanistan to Maldives to Zimbabwe\, the Berklee Online Music Business Capstone course\, and the Berklee Online Graduate Music Business Law class. \nHarrington was the Expert Witness responsible for freeing the iconic civil rights anthem We Shall Overcome in 2018. He co-authored two successful amicus briefs for defendants Led Zeppelin and Katy Perry in the United States Court of Appeals for the Ninth Circuit in 2020. (The Led Zeppelin decision was affirmed by the U.S. Supreme Court on October 5\, 2020.) DESCRIPTION:GUEST SPEAKER:  Bart Herbison  \nA Paris\, Tennessee native\, Bart Herbison spent 14 years in commercial radio\, worked as a reporter and as a correspondent for The Nashville Banner newspaper before joining the administration of former Tennessee Governor Ned McWherter as Deputy Director of Communications in 1987. Herbison joined the staff of U.S. Rep. Bob Clement (D-Nashville) in 1988 where he served as the Tennessee Congressman’s Press Secretary\, Campaign Manager and Chief Tennessee Administrative Officer before leaving Capitol Hill for Music Row in 1997. \nHerbison is Executive Director of the Nashville Songwriters Association International (NSAI)\, the world’s largest not-for-profit songwriters trade organization and advocacy group dedicated to the songwriting profession. Established in 1967\, NSAI’s membership of nearly 5\,000 spans the United States and other countries. With nearly one hundred chapters\, the association serves aspiring and professional songwriters in all genres of music. They also own The Bluebird Cafe in Nashville\, Tennessee. \nUnder Herbison’s leadership NSAI gained prominence in the national legislative arena. Accomplishments include: \n\nAdoption of the “Music Modernization Act” in 2018\, the most important copyright law reform for songwriters in decades.\nCreation of the Mechanical Licensing Collective of which he is a board member.\nLed NSAI’s involvement in the 2016 Copyright Royalty Board (CRB) trial that led to a historic 44% mechanical royalty increase for American songwriters and the subsequent CRB IV.\nPassage of the landmark “Songwriters Capital Gains Tax Equity Act” in 2006.\nCreation of the first-ever Group Copyright Infringement Insurance for songwriters and music publishers in a partnership with Frost Specialty Inc.\nAcquisition of the world-famous “Bluebird Café” in 2008.\nPurchase of the “Music Mill” studios as NSAI headquarters in 2005.\n\nIn 2018 Herbison received two prestigious national honors for his songwriter advocacy work — the “Industry Legacy Award” from the National Music Publishers Association (NMPA) and the “IP Champion’s Award” from the U.S. Chamber of Commerce Global Innovation Policy Center. He serves on the Board of Directors of the Mechanical Licensing Collective. DESCRIPTION:Tom Clees\, Panelist \nTom Clees is Senior Vice President of Federal Public Policy for the Recording Industry Association of America (RIAA).  As a lobbyist and political strategist for RIAA\, Clees represents the major American record labels’ interests before members of Congress and their staffs. This work has included advocacy on issues including copyright and intellectual property protection\, digital trade and content moderation\, COVID-19 relief for the music community\, and social justice reforms. DESCRIPTION:Lynn Morrow interviews Gary Christiansen\, President at Christian Copyright Licensing\, Inc. (CCLI)\, which serves over 250\,000 churches globally with music licensing and resources.  Come learn what rights are involved in their licensing and what products CCLI provides to churches.  Understand how CCLI’s offerings differ from a PRO and how they relate to the rights of music publishers and record labels.  Hear specific needs of the global church and how CCLI strives to meet those needs. \n \nLynn Morrow\, Attorney \n Adams and Reese \nRepresenting regional\, national and international clients\, Lynn advises and advocates for businesses and organizations that promote music and other forms of entertainment\, and helps artists\, authors\, songwriters\, music publishers and producers negotiate deals. She also works with independent publishing companies\, record companies and large non-profit ministries with a music element\, helping them to protect their intellectual property and content. Previously a litigator\, Lynn brings courtroom and negotiation skills to her practice. \nLynn writes extensively on copyright and entertainment-related subjects\, and her article\, “The Recording Artist Agreement: Does it Empower or Enslave?” was published by the Vanderbilt Journal of Entertainment Law and Practice. In addition\, Lynn speaks frequently before legal and entertainment industry audiences. Lynn is the past Chair of the Entertainment and Sports Section of the Nashville Bar Association and Tennessee Bar Association. In 2013 and 2018\, Lynn was named Best Lawyers® Lawyer of the Year in Entertainment Law in Nashville\, and since 2008\, she has been ranked among Best Lawyers® in Entertainment Law – Music\, Copyright Law and Intellectual Property Law.  Lynn assisted in the development of the firm’s Entertainment and New Media Practice Group. \n  \n \nGary Christiansen\, President\, CCLI \nA 25-year veteran of the company\, Christensen joined the CCLI team after a 20-year career in banking.
